Privacy Policy

1. Who this policy covers

This Privacy Policy explains how AgencyAtom Inc. (“AgencyAtom”, “we”, “us”) collects, uses, shares and protects personal information when you visit agencyatom.com (the “Site”), contact us, book a call, or work with us as a client.

AgencyAtom Inc. is a corporation based in Ontario, Canada. We handle personal information in line with the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada’s Anti-Spam Legislation (CASL). Where clients or their customers are located in the United States, the European Union or the United Kingdom, we also follow the privacy rules that apply there when acting on those clients’ behalf.

By using the Site or working with us, you agree to this policy. It should be read together with our Terms of Service.

2. What we collect

Information you give us. When you fill out a form, book a call, email us, sign a proposal or become a client, we may collect your name, email address, phone number, company name, website, job title, billing address, and anything you include in your message or on a call.

Information about your business. During an engagement we collect what we need to do the work: platform account access, brand assets, product and pricing details, campaign performance data and revenue figures tied to email and SMS.

Payment information. Invoices are paid through third-party payment processors. We see your name, billing details and payment status. We do not store full credit card numbers.

Information collected automatically. When you visit the Site, we and our analytics tools may collect your IP address, browser and device type, pages viewed, referring site, and how long you stayed. See Section 4.

Information from other sources. For business outreach we may collect publicly available professional information, such as your name, role, company and business email from LinkedIn, company websites or business directories.

3. How we use it

We use personal information to:

Respond to your enquiries and schedule calls.
Prepare proposals, audits and quotes.
Deliver the services in your engagement and communicate with you about the work.
Invoice you and collect payment.
Send you marketing emails about our services, where permitted (see Section 8).
Run, secure and improve the Site.
Meet our legal, tax and accounting obligations.

We only collect what we need for these purposes, and we do not sell personal information to anyone.

4. Cookies and analytics

The Site uses cookies and similar technologies to keep it working, remember your preferences and understand how visitors use it. We do not currently run analytics or advertising pixels on the Site. If that changes, we will update this policy.

You can block or delete cookies through your browser settings. The Site will still work, though some features may not. Where the law requires it, we ask for your consent before setting non-essential cookies.

Scheduling tools, contact forms and embedded content on the Site may set their own cookies under their own privacy policies.

5. Client customer data

When we work inside a client’s email or SMS platform, we have access to that client’s subscriber and customer data: names, email addresses, phone numbers, purchase history and engagement data. This data belongs to the client. We act as a service provider on their instructions.

For that data, we:

Use it only to perform the services in the client’s engagement.
Do not export it, copy it to our own systems or use it for any other client or for our own marketing.
Do not sell it or share it with anyone the client has not approved.
Follow the client’s written instructions and their platform’s data rules.
Return or delete any copies we hold when the engagement ends, on request.

If you are a customer or subscriber of one of our clients and have a question about your data, contact that brand directly. Their privacy policy governs how your data is collected and used. We will help them respond to your request where we can.

6. Who we share it with

We share personal information only where needed to run our business:

Service providers. Tools we use to operate: Google Workspace (email and file storage), Calendly (scheduling), Notion (project management), Slack (communication), Airwallex (invoicing and payments) and AI-assisted writing and research tools. Each is bound by its own privacy terms and only receives what it needs.
Subcontractors. Freelancers who help deliver client work, under confidentiality obligations and only for the engagement they work on.
Professional advisers. Accountants, lawyers and insurers, where required.
Legal requirements. Courts, regulators or law enforcement where the law requires it, or to protect our rights or safety.
Business transfers. A buyer or successor if AgencyAtom is sold or merged, under the same protections.

We do not sell, rent or trade personal information.

7. Storage, security and retention

We protect personal information with reasonable safeguards: password managers and two-factor authentication on our accounts, access limited to the people who need it, and confidentiality obligations on subcontractors. No system is perfectly secure, so we cannot guarantee against every breach. If a breach creates a real risk of significant harm to you, we will notify you and the Privacy Commissioner of Canada as PIPEDA requires.

Cross-border transfers. Our service providers, including Google, may store or process data in the United States or other countries. Information held there is subject to the laws of those countries. We choose providers with strong security practices and contractual privacy commitments.

Retention. We keep client and prospect information for as long as we have a business relationship and for up to 7 years afterward for tax, accounting and legal purposes. Prospect information we collected for outreach is deleted or anonymized within 2 years if no relationship develops. Client customer data is held only for the length of the engagement, per Section 5.

8. Marketing emails and CASL

We send commercial emails only where CASL allows: with your express consent (for example, you filled out a form and opted in), or under implied consent based on an existing business relationship or a business email address you published in a way that invites contact about your role.

Every marketing email we send identifies AgencyAtom Inc., includes our contact details and includes a working unsubscribe link. Unsubscribe requests are processed within 10 business days, and usually right away. You can also unsubscribe by emailing reydcronkwright@agencyatom.com.

Unsubscribing from marketing does not stop transactional emails about an active engagement, such as invoices, approvals and project updates.

9. Your rights

You can, at any time:

Ask what personal information we hold about you and get a copy.
Ask us to correct anything that is inaccurate or out of date.
Withdraw consent to our use of your information, subject to legal or contractual limits. Withdrawing consent may mean we cannot continue an engagement.
Ask us to delete your information, where we are not required to keep it.
Ask how we handle your data or raise a concern.

To do any of these, email reydcronkwright@agencyatom.com. We will respond within 30 days. We may need to verify your identity first.

If you are not satisfied with our response, you can complain to the Office of the Privacy Commissioner of Canada at priv.gc.ca. If you are in the EU or UK, you may also contact your local data protection authority.

10. Children, changes and contact

Children. The Site and our services are for businesses and are not directed at anyone under 18. We do not knowingly collect personal information from children. If you believe we have, contact us and we will delete it.

Changes to this policy. We may update this policy from time to time. The current version is always posted on the Site with its effective date. Material changes will be flagged on the Site or emailed to active clients.
